Copyright law is a set of rights belonging to authors and other rights owners (performers, producers, broadcasters …). Copyright laws provide procedures in cases of infringement of exclusive rights, protection of rights of remuneration, and, in some jurisdictions, provide moral rights. These laws offer protection to the holder of the copyright, whether the rights belong to the author, a third party, or holders of related rights.

In countries that have signed the main international copyright treaties, such as the Berne Convention, the registration in the national copyright services is voluntary. Enrollment in a public registry is not mandatory to acquire a copyright or to obtain the protection that laws grant to authors and other copyright holders. However, registration does serve to protect those rights, since they create a “iuris tantum”: rebuttable presumption of the existence of those declared rights.

Since international copyright treaties do not require formal requirements to protect the authorship and exploitation rights of works (which generally last for the creator’s lifespan plus 70 years), judges will assess all the evidence presented in case of conflict to resolve the competing rights, whether the evidence comes from public records or not.

Therefore, a private copyright registration has the same effctiveness and the advantage of offering evidence of authorship as public registration would in deterring plagiarism – in many cases free of charge – and has the advantage of generating the strongest technology based global evidence, immediately available and transparent online information, which facilitates interaction between rights holders and the users of the works.

Ensuring the integrity of the registered work:

The registration record is accompanied by a digital copy of the copyrighted work or of a representation or description sufficient for unambiguous identification of the content.

In conducting the registration, the computer system uses two functions or algorithms to generate two different keys, of which each separately can be used at any time to check the integrity of the file.

Three keys are extracted from the deposited file: one usding a MD5, the other using a SHA1 algorithm and the other using a SHA 512 algorithm.

With this system the proof that guarantees that the file has not been modified is based on the fact that it relates not only to a single hash code, but to three different ones simultaneously.

The technical assurance of the integrity of a file that can simultaneously address two key hashes is absolute.

Registration date guarantee:

To also offer a reliable and irrefutable guarantee of the accuracy of the registration date, the system uses time stamping technology, and as it does with the file integrity identification keys, it is also applied reduntantly by stamping one time stamp to the registered file keys with Safe Creative’s time stamp server, and over this time stamp applying a second one from Firma Profesional (Ministry of Industry of Spain homologated time stamp server) thus demonstrating the exact coincidence of dates in both servers at the moment it happened and therefore a total accuracy.

What is the difference between registering at Safe Creative or at a traditional copyright official registry?

When authors register their works on a copyright registry, they are creating an authorship proof they might use in case it’s needed.

Safe Creative adds long requested values to improve security and legal enforcement to the new dimensions of copyright:

Works’ format: Traditional registries have specific rules many times quite outdated. For instance they state that for musical creations it’s mandatory to provide a score and do not allow the MIDI or .ogg nor .mp3 formats.

New licensing options: Besides authorship in Safe Creative, you can state the exploitation rights policy you want, as well as the most common open or copyleft licenses.

Global: As official copyright registries are national, you are limited to a territory. Safe Creative receives and gives information worldwide, so you can search for registered works in other countries.

Free of charge: Safe Creative has a basic service which is free of charge. Anybody can use it not needing to spend any amount of money.

Agility: Being an on-line service, authors can modify the rights they keep on their works. The registry keeps track of the license changes and end-users can check the actual rights at any moment.

Anyway, the deposit of a work in a traditional registry and in Safe Creative are not excluding. Authors can strengthen the authorship proof by registering in both systems.

Safe Creative needs certain rights to register, make available the work and other purposes (such as indexing, streaming,…), so the user must authorize this. This authorization excludes any act of exploitation different from the uses strictly listed above, which does not affect the commercial use of the work.

Users can register on Safe and not give any right, but then the registration will have to be private; Safe Creative will then not allow the download the work by others, nor will be possible to turn some professional services on, or anything else than just storing the work.

There are several ways to register one or several works.

a) Basic registration of a work through Safe Creative’s web:

1.- Log into your account

2.- Click on “Register ”

3.- Select the type of work you want to register

4.- Follow the wizard’s instructions

5.- After completing the steps and introducing all relevant data do not forget to hit either “Keep as pre-registered” if you plan to make changes in the file, title or your identity in the next 24 hours or hit “Finish registration” if the data provided including the file is final

b) Automatic registrations using:

1.- ART

2.- Blogs or other periodical publishing systems

Any kind of work, document of file can be registered at Safe Creative, however you must be aware that not all works are protected by copyright laws. According to the World International Property Organization’s Berne Convention for the Protection of Literary and Artistic Works copyright include:

Literary works: articles, tales, novels, essays, posts, electronic pages, etc.

Dramatic and audiovisual works: movies, animations, theater, short films, etc.

Musical works: musical compositions, phonographic productions, scores, etc.

Artistic works: drawings, paintings, designs, three-dimensional models, sculpture, engravings,
lithographies, comics, photography, etc.

Databases and software (in some legislations): the code (whatever format) and their manuals and related technical documents, graphics and description modules.

Any file format that contains a copy of the work or enough identification about it: pdf, doc, txt, odt, midi, wav, mpg, score, jpg, swf, etc…

Currently the maximum filesize allowed is 400Mb. For large files, starting with tens of megabytes to the mentioned limit, we highly recommend to use our free of charge ART software.

Safe Creative allows the registration of specific copyrights to previously registered works.

The inscription will show:

– The title of the right,
– the area of operation,
– the time scope and
– the environment in which such ownership is specified.

Follow this steps:

* Log into your account

* Go to “my registrations” “register rights”

* look for the work you wish to register rights of, either with the title or registration code

* Confirm the work

* Introduce the required data and save it.

* The information will appear in the record’s copyrights’ information page.

All registration evidences are stored on our servers indefinitely.
Registrations made in basic accounts are archived after 12 months but are not deleted. All archived registrations and evidences are still valid, but no public information is provided, nor internal management is possible.
Archived registrations will return to public display and be manageable whenever a professional or agent account is hired in the future.

Once a work is registered neither the title, author or content of it can be modified as the registration proof is based in the fact that “that” is the precise works that was registered at a specific time and UTC time.
However, any modification is susceptible of new registration, though it is recommendable not to create confusion to the possible users by registering too many times the same work with no substantial changes. Whenever the author of a work makes any kind of change on it and registers it again, it becomes a “derived work”, by the 11th article of the Law of Intellectual Property (Spain).

Regards the title of a modified work and registered again, the Law does not prohibit to keep the same title as the first version.
It could be that two works from different authors have the same title. In that case, the Intellectual Property Law (Spain) in it’s 10.2 article, says that a title is only protected whenever it’s original. Is quite commons and perfectly legal that two authors have each one a song with the same title “The Dawn”. On the other hand a title containing, for instance, the name of one of the main characters of a the book like “Alice in Wonderland” would be considered as original and thus protected by copyright laws.

What you can change:

* The license of the work.
* Whether the registration is public or not (if others can see who the author is and he’s rights).
* Whether download of the work is available or not (if other, when consulting the rights, will be able to download the work)

Yes, this is an author’s right recognized by most legislations, though it is important that the author is aware that the modification of a license will be effective for those who use the creation after that change takes place, not affecting this change to those who might have acquired or used the work under prior conditions.

It is important, to guarantee legal safeguards, that those authors modifying the conditions in which they make the work available, clearly notify that the license has changed to avoid this way any mistake with those who might have used the work previously.

When registering a work in Safe Creative, the system provides a registration number and a label that identifies it.
It is not an empty tag content (hence the informative nature of it). Asked for information, if it is linked, through the html code, will provide direct access to the registration informative page of the work, where data is found as title, author or authors, rights holders, date of registration, license granted…
In this registration informative page users can optionally request a registration declaration.

Index tags are keywords* that allow the organization of our records according to their different contents.
May be included at the time of registration or later when editing the work. Also through an joint action, editing several works at once.
This labeling scheme allows to classify the different records as if it they were in a folder system. The tag indexing works as a “labels” system for content, classifiyng them. They facilitate the search within our account and allow other users to find specific content that can help them to get to our work (if it is a public record).

* The various index tags must be entered separated by commas.

When talking about registering a blog we can talk about two different issues:

1.- Register the blog itself: the design template, drawings or images, code, structure… In this case, the registered work to be protected is the very blog.

2.- The contents published in the blog: in this case the blog is only the publishing media. The work that has to be registered to protect and inform about author’s rights are the posts, as literary works. To register your posts you can use our automatic feed registration.

1.- Registration of a blog as a work

In the first case, it is possible that only the graphical elements or design templates are wanted to be registered. In this case a file containing the template with the images and the rest of the components of the work should be uploaded.
Making the registration it can be stated under the “artistic” category as electronic pages and multimedia.
If the development of the blog also includes the programing code, it can also be registered all together as “software project”, or there can be a registration for the project itself and another registration for the design.
It’s not specially relevant to choose one or other denomination, for the work gets registered and stored anyway, and this classification is aimed to provide some orientation for the search and query features.

2.- Registration of the posts of a blog

The second option is that the work to be registered is not the blog itself, but the contents in it. The blog is a publishing platform, where one or various authors might publish and not all the posts might have the same license. It is also possible that an author publishes an article in a blog and later publishes the same article, for instance, in a magazine, a book or any other media.

In this case, the posts are the ones to be protected or identified with the registration tag to inform about the rights.
They can be registered each one individually as they are written, or all of them together included in documents or files…

Once registered, the specific html code of the registration can be added to the post linking it this way to Safe Creative’s information page.

To use this feature do as follows:

3.- Click on “+Add a new work feed”

Important notes on the automated registration through an RSS feed

The RSS feed or files usually allow two publication choices:

1.- Publication of only the headline and an intro with each item header.

2.- Publication of the full content of the article.

By automating the registration of a website through your feed or RSS channel, Safe Creative will only take the very content recorded in the RSS file itself, so it is very important that it contains the full article, otherwise the registration evidence will only be of the headline and intro text that includes the feed.

Check the settings of your system to confirm that the feed includes all the content and, if not, change your settings as soon as possible.

We recommend that, once activated, you to check in the first registrations that indeed the feed is publishing articles with the correct format and content, being what you intended to register. You can do this by downloading the file registered and thus checking its contents.

Also keep in mind that any RSS feed to work properly must have a date and hour of publication for each post. This is common on most standard blogs, but could be missing in some cases, so, please check this too as the registration could not work as expected if date was missing.

1.- go to the public registration information page and then click on “Get copyright registration declaration” or

2.- locate the record in your “My registration page”, clic on it and request it through the option on the left or

3.- Select one or several works from your registration listing and hit “Manage selected works” and hit “Get informative notices”.

The registration declaration is a document which contains all the authorship and copyright information that has been registered in Safe Creative for a specific work.
The registration declaration provides relevant data on those works we want to use and which are very valuable in the case of being warned of alleged misuse of it.
It is desirable that the user of a copyrighted work obtains it. Why? It identifies the work with the registration code, title, author or rights holder, registration date and, above all, with the valid license given at the date of application.
The note will provide support to users in the event that the author changes the license first given, for under the varying conditions might occur that he or she decides to claim misuse of an earlier accessed work.
Registered works can be deleted from the edition page, but for security reasons for those users who might have consulted the registrations and the rights, the deletion means that the inscription will not appear on the queries of the registry, but Safe Creative keeps the information as a security procedure.

The note, therefore, supports the user of another’s work.

3.- Advanced features

To increase the level of identification of a user account, we should know that these are 4:
How can a user go up to another level?

Level 1: email address and access to the account has been confirmed.
Level 2: The user has added to the account, besides email, basic contact information: postal address and telephone number.
Level 3: Safe Creative user accesses using an international identity certificate issued by a company (now Verisign: http://www.verisign.com/authentication/digital-id/index.html) or has purchased a professional account on the registry.
Level 4: Safe Creative user accesses using a digital identity certificate issued by an Administration (now the DNI-e of the Ministry of Internal Affairs of Spain and FNMT certificate from the Ministry of Economy and Finance of Spain)

If the confidentiality of the user’s password has been compromised, it should be changed for a new one going to “My account”.
If the copy of the digital certificate and it’s PIN has been compromised, it also should be de-attached from “My account”.
The certificate might be revoked by the entity that issued it, thus enabling legal repudiation of any activity performed in dates posterior to the revocation instant.
It is important to state that the rigor and validity of the registration in Safe Creative is based on the proper use of the technology the user manages.

Safe Creative provides the ability to generate a copy of the record with the following relevant metadata: Title of work, name of the author or authors and the link to the registration information page (URL). This way it is always possible to access the latest updated information of the registered work. The link to the registration page Safe Creative is a pointer to the address where the information is displayed.

Metadata is information included in the digital file.

It is possible to generate a version with metadata for the following recorded files: .gif, .png, .jpeg, .jpeg2000, .tiff, .psd and .pdf

In these cases the editing screen of the record has a link “Download file with copyright information”, and if you select the registration type “Public registration and download allowed” you can establish whether the file to download will be the original or a copy with metadata. The latter can also be changed to multiple registrations simultaneously, selecting them in the list of works and choosing the edit action.

Metadata are exported using a standard nomenclature:

Title of work: Dublin Core: title
Author / s: In the authorship inscriptions (not the ones with only patrimonial rights marked) Dublin Core: creator and in pdf files also in the author field.
URL rights information: Dublin Core: rights and XMP-Rights: webStatement
Work Code: IPTC Core v1.1 v1.1 For XMP extension : regItemId

Safe Creative’s certificate is a technically irrefutable true registration evidence independent even from Safe Creative.

The new registration evidence is twofold and together with the original file consists of:

– A proof of identification and integrity of the work, consisting of a triple fingerprint identification system: MD5, SHA1 and SHA512.

– An equally strong proof of the date and time at which this work was registered with a separated double timestamp for each work: by a certification authority approved by the Spanish Ministry of Industry, and the certification authority of Safe Creative.

This certificate may be downloaded or automatically received by authors. This way users will keep an evidence independent from Safe Creative.

The registration certificate that turns to be a full registration proof together with the registered file is available for Professional and Corporate accounts and will be automatically generated for records made from basic accounts also, so that those users may download them when hiring any of the aforementioned.

You can request the certificate by locating your registration at “My registrations” or your “Dashboard” and clicking “Manage registration – Download registration certificate”

Please note:

To obtain the Registration certificate of a work the registration must be final.
The definitive registration implies that none of the relevant data might be changed, such as title, author and the work itself.
SAFE CREATIVE can provide a pre-registration period during which the author can perform all sorts of changes. After this period, the record is definitive and firm and can be the Registration certificate can be obtained.

You can finalize the pre-registration period anytime.

Safe Creative’s registration evidence includes, in a single file, all the elements that allow to unequivocally identify the work together with the time and hour of registration:

– The registered file / description of the work
– Three fingerprint identifications: MD5, SHA1 y SHA512
– Two time stamp for each work: by a certification authority approved by the Spanish Ministry of Industry, and the certification authority of Safe Creative

This is in short, to provide full evidence in judicial or arbitration proceedings, able to irrefutably identify the work and the time of registration.

It is posible le to configure your account at Safe Creative to automatic register your files stored in GoogleDrive and DropBox

– Log into your account
– Go to “SERVICES – automatic registrations”
– Clic on the “Google Drive” or “DropBox” tab at the right
– Clic on “New registration from Google Drive/DropBox”
– Follow the wizard to add name, name of folder. If not existing the folder will be created in Google Drive or Dropbox*.
– Then you will be prompted to authorize that Safe Creative registers from your Google Drive or DropBox
– Once authorized wait a few minutes to put your files in the Google Drive** or DropBox folder

*In the case of DropBox new folders will be created in the applications folder.

** In Google Drive editing files in the registration folder will mean them to be registered again, so it’s advisable only to put final or near final works there. All files will be exported and registered as PDF files.

The tracking service is a feature that will report you places in the Internet with copies of your pictures, being able to take actions as you wish.

– Locate or select the picture or pictures you want to track
– Hit “manage” if a single work or “manage selected” if several
– A pop up window will open with the different options. Choose “Enable image tracking”
– If the first activating this service from Safe Creative you will be asked to either create a new account or log into an already existing one (if you have any).
– Activate the tracking by clicking at the “Enable tracking” button.
– The system will be continuously checking for matches.

Check matches:

– Go to “Services – Tracking images”
– Found matches will be listed here.
– You can check the page where the match has been found or check details.
– If you hit details you will be able to make a PageStamper capture of the page with your image, if you have activated it and you can also go directly to ImageProtect page to request other actions and view the rest of the information.

Notice: This is a beta service. Specifications might change. ImageProtect service is free of charge for our professional users. ImageProtect will pay directly to our users through their account in that platform. There is a revenue share of the settled amounts: The revenue share is 50% of the net settlement after legal, collection, and/or processing fees.

It’s possible to generate a single label to inform in the Internet about the registered item that are part of a collection, such as a music album, an anthology, etc.

To create a collection we have to log into our account and:

1.- Go to “My registrations” or “Dashboard” in the case of Corporate account.

2.- Select the works to be part of the collection. You’ll b e able to add more in the future.

3.- Hit the manage selected button

4.- Select “Add to collection”

5.- Create a new collection or use an existing one

Once you have a collection and wish to get the identification labels, links or change the order of the items in it, go back to “My registration” or “Dashboard” main tab and:

1.- Where you’ll find “My registrations” and “My collections” hit on this last one

2.- There you’ll be able to see, edit, grab labels or delete the collection. Notice that by deleting the collection you will not delete the registrations in it.

This is a feature included in Professional and Corporate accounts.

It’s possible to reserve a registration code and complete all registration information without uploading the file containing the work.

The record will appear in “My registrations” view marked as “Reserved”.

Among other needs or possibilities, the code reservation permits the early request of the informative registration labels so they can be attached to the file containing the work.  The file with the work and the registration label or any other information can then be uploaded in a last step by editing the record.

The timestamping of the UTC date of actual registration will be completed with the date of the UTC time when the file is finally copied in our servers and registration becomes final.

This is a feature included in Professional and Corporate accounts.

When users of Safe Creative do not have any of the three electronic certificates that the registry actually recognizes to increase the level of identification (DNI-e, FNMT from of Spain, or International Verisign Certificate) they might attach any other document that helps to identify them by attaching it to the personal profile. Users might scan any document (such as passport, deed of founding of a company that owns rights of a work, Social Security Number, driver’s license, proof of establishment deed of a musical or theatrical group,…)

One version of a work is when we change it substantially in such way it’s necessary to perform a new registration. To keep the traceability to know from what original work it comes from you can use this system to manage different versions of the same work. Just enter the original work and choose to register a version of it from the “Manage my work” button. It then adds a record associated with the original work but still independent.

How to use it:

1.- You have find the first recorded work

2.- Hit the management button and select “Register new version” or clic directly on the thumbnail in case of having a Corporate Account.

3.- Select the local file with the version of the work

4.- After is uploaded hit “Register new version”

 

Once a new version is registered, the information about any version existing will be displayed in the registration page of all related works and in the list of registered works.

Sometimes you would like to add some kind of a attachment to a work in order to report, supplement, or make clear any particularity of it and so on. You can send documents such as contracts (for the case of shared ownership of rights) that specify the degree of ownership that exists, mock ups, details of the work in the case of for example a sculpture or a painting, etc..

The document is also sealed up digitally and may be publicly shown, downloaded or not, etc..

A work may have been created by two or more authors. In Safe Creative it´s possible to record new authors in a work’s registration so they will appear both in the information page and registration declaration to be sent.

1.- Go to “My registrations” or “Dashboard” view of your works and locate the record you want to manage.

2.- Clic on the work’s icon

3.- Locate “Authorship and rights inscriptions” section.

4.- Select “Add coauthors”

5.- A window will pop up and there you can add the email addresses to which the coauthors will receive the request to join as coauthors. They can accept it, or not, by logging into their own account, or create a new one if not having one already. To accept this coauthorship invitation basic account can too be used

6.- Mark if you will allow those coauthors to be able to modify the registration information or not

7.- Click on “Add rights holders”

Invited rights holders will be able to accept the request or not, using any type of account.

Invitation can be resent if coauthors get not the invitation.

In the case or event of your work being plagiarized or used in an allegedly unlawful manner now you can send Cease and Desist letter directly from Safe Creative. You can select the option clicking on the icon of the work in “my registration” view. You will find the “Send Cease and desist” option. The system will generate a letter requesting to stop such activities to the person allegedly infringing your copyrights.

To complete the letter you have to get the email address of the alleged offender. He or she will receive an email with a link that allows him or her to answer. When the issue gets answered you will receive notification of it by mail. Upon receipt of that response you can decide new actions to take. Before using this utility we highly recommend you to seek the advice of an attorney.

Professional and corporate accounts adds more statistic information to the basic service:
-number of downloads of works (in general or for a specific work),
-number of briefings requested (in general or for a specific work)
-contact details of users who requested the registration declaration notes (if they have the public profile enabled)
-graphs which cover all the statistical information.

An evaluation version of a work is a file with a lower resolution or that does not contain the complete work and that can be shown or downloaded.

To upload an evaluation version of a work do as follows:

1.- Lo into your account

2.- Locate the work in your “My registrations” or in your “Dashboard” section

3.- Hit the thumbnail to manage it.

4.- In the section “Files” hit “upload file” at the right of “Evaluation”

5.- Select the evaluation file in your computer and wait it to be uploaded

6.- Hit “Save”

What is the U.S. Copyright Office?

The U.S. Copyright Office (USCO) is part of the Library of Congress in the United States and primarily serving as an office of records where documents related to copyright are stored and recorded.

The USCO also plays a role in advising the U.S. government on matters of copyright, including providing reports and assisting with drafting legislation.

Why Should One Register with the U.S. Copyright Office?

Registering with the USCO has a series of benefits including:

  1. Creates a public record of the registration of copyright.
  2. Serves as prima facie evidence in U.S. courts of ownership of the copyright and of all facts contained in the registration, greatly bolstering a case.
  3. U.S. citizens are required to register before filing a lawsuit for copyright infringement.
  4. If a work is registered either before the infringement takes place or within 3 months of publication then, in the U.S., the copyright holder is eligible for both statutory damages, which can reach $150,000 per infringement, and attorney’s fees.

To be clear, even though non-citizens can sue for for copyright infringement in the U.S. without a registration being filed, they are only able to claim actual damages, which is the greater of what the copyright holder lost or the infringer gained from the use of the work. In many cases that amount is effectively zero.

In short, if you might ever have cause to sue in the U.S. you should register your work in a timely manner so that you have all of your rights at your disposal.

What Can be Registered with Safe Creative in the U.S. Copyright Office?

Most works created in a digital format are eligible to be registered: literary works, videos, sound recordings, visual works, even masks, periodicals and more.

However, for works with usually very large file sizes, such as feature-length movies, the file you use to identify the work must not be larger than the file size limit in Safe Creative (400 Mb right now).

How Long Does it Take to Get My Registration Certificate?

Safe Creative will make the application for USCO registration usually within seven labor days. You will be able to check the situation of your works’ registration in your Safe Creative account.

The USCO, unfortunately, has a large backlog of certificates that it has to send out. As such, even with an online registration, it can still take 3-9 months or longer to get your certificate. However, certificate times fluctuate wildly and some report getting their certificates in as little as six weeks.

When is My Work Considered to be Registered?

The effective date of registration is the date that the registration was filed. If you register online, that’s the date that the online form was submitted.

This means that, even if it takes several months to get your certificate, which is often the case, the date in which the registration takes effect is still the day it was received.

To register works which are in Safe Creative at USCO you need to provide us with some additional information and data. Though we already have much of the required information the rest should be provided in an assisted process.

1) Work Data

Title: title of the work to be registered. By default the system uses the same title as it appears in Safe Creative, but it can be changed.
Type of work: select the type of work. If neither type corresponds to the work to be registered, do not continue with the process, make sure is a kind of work that USCO allows to be registered through it’s electronic office, or contact Safe Creative.
Published work verification work: if the work has already been published you must check this box.
Date of first publication: if published, write the date the work was published for the first time.
Country of first publication: if the work has been published in several countries, select the first in which it was published.
Year of creation: the year the work was originally created, which may be before the date of publication or the same year. By default the system takes the year the work was recorded in Safe Creative, but since it might have been created before, you can tell the correct date here.
Standard Code Type: there are different types of standard code numbers depending on the type of content. Select any of the international standard code types corresponding to the published work.
Standard Code Number: enter here the international standard number of this published work. Note that the standard code is usually different depending on the type of work we are dealing with.

2) Authors

This screen will allow you to set the different contributions of authors to the work.
If more than one author, you will be able to specify the contribution of each.
Name, middle name and surname are taken from the existing default information in the database, but can be modified.
Country of Residence: current country of residence of the author.
If you want to register under pseudonyms instead of real name, check the box “This author uses the following pseudonym” and then type the alias you use.
You must specify which is the author’s contribution or contributions to the work being registered.
In “other” you can write a type of contribution that is not listed among the options displayed for this type of content.

3) Holders of rights

This screen shows all the record-holders of the work rights that have been stated in Safe Creative, with name, surname, address, and other information. All of them must have be previously registered at Safe Creative for this work.
Include in the USCO registration (must be owner of rights in the U.S.) this box is checked when the ownership of rights is valid in the USA.
Address 1: regular direction
Address 2: you can add a second contact address
Type of rights transfer: you must specify the type of transfer of rights that has been made. If it is “author” those are by default, but if you are not author of the work you must specify whether it is by writing agreement, by will or otherwise. If “other” you must specify which is it in the box to that effect.

4) Contact and Shipping

In this screen we specify up to two contact addresses for two different purposes:
Contact: is optional and allows that people interested in the work they see at USCO registration information system can get in touch with the person who applyed for registration.
Mailing Address: this address will be used by USCO to send you their registration certificate once finished.

5) Review and Payment

This screen displays a summary of what is going to be sent to be registered, and all the information provided to that effect. It is important to make sure everything is correct, and if not, correct it before sending.
Completing the process
Once everything is correct we must hit “finalize registration”.
At that time the system will present us a screen with the terms of use to be read. Once reviewed go to accept them by checking the bottom right checkbox.
Payment of the service
After you give the ok to the terms of use you will be prompted to pay the marked amount*.

The ISAN code is a voluntary numbering system, similar to the ISBN used for publishing or the ISWC for musical tracks, for the identification of audiovisual works. Each ISAN code identifies a unique audiovisual work and remains unchanged throughout the life of the work, regardless of language, format or use that is given to it. The ISAN code is a unique reference number, permanent and internationally recognized for audiovisual works identification.

It’s a tool that improves the management and operations of the global audiovisual industry and its use as a simple and unambiguous reference to the work is used by many organizations, including the Property Registry of Spain.

It is a 24-digit numeric code divided into three parts:
Root: identifies the audiovisual work.
Episode: identifies the parts of a serial work.
Version: Identifies the versions of a work.

Example: 0000811F 0000-0000 0000-0000

Its purpose is to identify any audiovisual work by assigning a universal code. This unique identification allows a more efficient management of the entire audiovisual industry in global operations.

The ISAN code is assigned by ARIBSAN under the authorization of ISAN-IA, which is responsible for the global ISAN system administration, and appointed by ISO as the registration authority for ISAN Standard. ARIBSAN is the registration agency authorized to manage and process ISAN codes of audiovisual works.

Any person or entity may request an ISAN code. It is intended for audiovisual industry professionals, producers, writers, broadcasters, distributors, advertisers, etc., and any organization or other entity representative of the industry sector.

The ISAN code assigned to a work, does not in any way constitute a proof of ownership or authorship of the work.

There are currently five types of registration depending on the type of file being registered and account being used.

1) None: No registration information is available. Only the account user can view information and download the work. Very useful if you do not want to give clues about what you are working on

2) Only registration info – (no download allowed): The registration information is public, but the copyrighted work can not be downloaded except by the author when logged in his or her account.

3)  With preview or play of work – (when possible if the file allows it, and with no download of the original registered file): The registration information is public. An automatic preview of an image or streaming of a mp3 is generated and available for the general public.

4) With download of original file: Registration information is accessible from anywhere on the Internet and anybody can also download the work. There’s no track of who downloads the file. Be cautious if choosing this.

5)  With download of file with registration info: Registration information is accessible from anywhere on the Internet and anybody can also download a copy of the work with metadata and public registration information of the work in it (only working now image and PDF files). There’s no track of who downloads the file. Be cautious if choosing this.

When you send a file to register, you can allow it to remain as pre-registerd or make it final in which case no further modification of the title, file and your identification can be made. If pre-registerd you can modify the title and the deposited content itself. You can also delete it all.

During pre-registration you may rectify anything you might have forgotten, or  make a last minute correction, or get the labels with the registration code to include it in the very work.

Registered works can be deleted from the edition page, but for security reasons for those users who might have consulted the registrations and the rights*, the deletion means that the inscription will not appear on the queries of the registry, but Safe Creative keeps the information as a security procedure.

*With regards to rights transferences, it is necessary to distinguish between moral and exploitation rights:
– Moral rights (authorship, integrity and disclosure) cannot be waived and are inalienable as stated at the 14th article of the Intellectual Property Law of Spain. In other countries, like USA, Canada, Great Britain, this is different for there are not moral rights as they are understood in the Continental Law.
– Exploitation rights (distribution, reproduction and public communication) can be waived; and once registered posterior registration can be made modifying the license. It’s also expected, during the evolution of the beta, to consider rights’ transferences.

Safe Creative allows the registration of copyrights to authorship rights registered works, showing in the inscription:
– The title of the right,

– the time scope and
– the environment in which such ownership is specified.

The automatic feed registering is used to automatically register the posts on a blog as they get published. To use it you have to associate the feed with a previously created profile.

To access the functionality you have to:

1.- Lo into your account

2.- Go to “Services – Automatic registrations – Registration feeds”

3.- Click on “+Add a new work feed”

4.- Follow the wizard’s instructions

On your blog, preferably in a area of the page to which access may be permanent, you have to publish one of the verification codes Safe Creative creates so that our bot will be able verify that the blog is yours.

You can also register file feeds, image feeds such as Flickr, Instagram, or podcasts introducing the the specific feed for those contents.

CreativePeople is the social network of SafeCreative, to promote the creators of musical, literary, and visual works.

Works can be sent to be featured on CreativePeople these ways:

  • During the registration process. When you register a work, you can select the option of allowing to preview it, download it, or viewing an evaluation version. If any of these options is available, the work can be sent to Creative People for more visibility. It must also belong to one of the aforementioned categories (text, music, illustration, photography, and crafts).
  • Through a registration profile. “My Account” > “Registration profiles and licenses”. When creating a new registration profile, there is an option to send works to CreativePeople. This way, anytime a new work is registered using this profile, it will also be sent to the social platform for more visibility.
  • Sending previously registered works. A work that has already been registered can be sent to CreativePeople from its own information page. There is a list on the left with an option to do so, as long as a the work can be previewed, downloaded, or an evaluation version is available to peview. It should belong to one of the categories featured on CreativePeople (text, music, illustration, photography, and crafts).

Once a work is registered neither the title, author or content of it can be modified as the registration proof is based in the fact that “that” is the precise works that was registered at a specific time and UTC time.
However, any modification is susceptible of new registration, though it is recommendable not to create confusion to the possible users by registering too many times the same work with no substantial changes. Whenever the author of a work makes any kind of change on it and registers it again, it becomes a “derived work”, by the 11th article of the Law of Intellectual Property (Spain).

Regards the title of a modified work and registered again, the Law does not prohibit to keep the same title as the first version.
It could be that two works from different authors have the same title. In that case, the Intellectual Property Law (Spain) in it’s 10.2 article, says that a title is only protected whenever it’s original. Is quite commons and perfectly legal that two authors have each one a song with the same title “The Dawn”. On the other hand a title containing, for instance, the name of one of the main characters of a the book like “Alice in Wonderland” would be considered as original and thus protected by copyright laws.

What you can change:

* The license of the work.
* Whether the registration is public or not (if others can see who the author is and he’s rights).
* Whether download of the work is available or not (if other, when consulting the rights, will be able to download the work)

To register works which are in Safe Creative at USCO you need to provide us with some additional information and data. Though we already have much of the required information the rest should be provided in an assisted process.

1) Work Data

Title: title of the work to be registered. By default the system uses the same title as it appears in Safe Creative, but it can be changed.
Type of work: select the type of work. If neither type corresponds to the work to be registered, do not continue with the process, make sure is a kind of work that USCO allows to be registered through it’s electronic office, or contact Safe Creative.
Published work verification work: if the work has already been published you must check this box.
Date of first publication: if published, write the date the work was published for the first time.
Country of first publication: if the work has been published in several countries, select the first in which it was published.
Year of creation: the year the work was originally created, which may be before the date of publication or the same year. By default the system takes the year the work was recorded in Safe Creative, but since it might have been created before, you can tell the correct date here.
Standard Code Type: there are different types of standard code numbers depending on the type of content. Select any of the international standard code types corresponding to the published work.
Standard Code Number: enter here the international standard number of this published work. Note that the standard code is usually different depending on the type of work we are dealing with.

2) Authors

This screen will allow you to set the different contributions of authors to the work.
If more than one author, you will be able to specify the contribution of each.
Name, middle name and surname are taken from the existing default information in the database, but can be modified.
Country of Residence: current country of residence of the author.
If you want to register under pseudonyms instead of real name, check the box “This author uses the following pseudonym” and then type the alias you use.
You must specify which is the author’s contribution or contributions to the work being registered.
In “other” you can write a type of contribution that is not listed among the options displayed for this type of content.

3) Holders of rights

This screen shows all the record-holders of the work rights that have been stated in Safe Creative, with name, surname, address, and other information. All of them must have be previously registered at Safe Creative for this work.
Include in the USCO registration (must be owner of rights in the U.S.) this box is checked when the ownership of rights is valid in the USA.
Address 1: regular direction
Address 2: you can add a second contact address
Type of rights transfer: you must specify the type of transfer of rights that has been made. If it is “author” those are by default, but if you are not author of the work you must specify whether it is by writing agreement, by will or otherwise. If “other” you must specify which is it in the box to that effect.

4) Contact and Shipping

In this screen we specify up to two contact addresses for two different purposes:
Contact: is optional and allows that people interested in the work they see at USCO registration information system can get in touch with the person who applyed for registration.
Mailing Address: this address will be used by USCO to send you their registration certificate once finished.

5) Review and Payment

This screen displays a summary of what is going to be sent to be registered, and all the information provided to that effect. It is important to make sure everything is correct, and if not, correct it before sending.
Completing the process
Once everything is correct we must hit “finalize registration”.
At that time the system will present us a screen with the terms of use to be read. Once reviewed go to accept them by checking the bottom right checkbox.
Payment of the service
After you give the ok to the terms of use you will be prompted to pay the marked amount*.

The ISAN code is a voluntary numbering system, similar to the ISBN used for publishing or the ISWC for musical tracks, for the identification of audiovisual works. Each ISAN code identifies a unique audiovisual work and remains unchanged throughout the life of the work, regardless of language, format or use that is given to it. The ISAN code is a unique reference number, permanent and internationally recognized for audiovisual works identification.

It’s a tool that improves the management and operations of the global audiovisual industry and its use as a simple and unambiguous reference to the work is used by many organizations, including the Property Registry of Spain.

It is a 24-digit numeric code divided into three parts:
Root: identifies the audiovisual work.
Episode: identifies the parts of a serial work.
Version: Identifies the versions of a work.

Example: 0000811F 0000-0000 0000-0000

Its purpose is to identify any audiovisual work by assigning a universal code. This unique identification allows a more efficient management of the entire audiovisual industry in global operations.

The ISAN code is assigned by ARIBSAN under the authorization of ISAN-IA, which is responsible for the global ISAN system administration, and appointed by ISO as the registration authority for ISAN Standard. ARIBSAN is the registration agency authorized to manage and process ISAN codes of audiovisual works.

Any person or entity may request an ISAN code. It is intended for audiovisual industry professionals, producers, writers, broadcasters, distributors, advertisers, etc., and any organization or other entity representative of the industry sector.

The ISAN code assigned to a work, does not in any way constitute a proof of ownership or authorship of the work.

First check your inbox spam (junk mail).
If our verification or to download email is nowhere to be found it’s likely that your email server is mismanaging “received” emails and making false unwanted email positive assumptions, removing at its discretion mails that completely fails to deliver.
Using @hotmail.com for these tasks can be problematic for this very same reason.
How may I solve it?
You can go to your hotmail settings of your account (top right gear icon), to “More email settings”, “Safe and blocked senders”, “Safe senders”, write “noreply@safecreative.org” address and “Add to list”.

Safe Creative is based on the technology to generate evidence of authorship as solid as economic and comfortable. However, to achieve the best evidence it is necessary to have the best information. ​​Therefore the strength of a registration depends very much on the quality of the information each user provides.

In addition to the file representing the work to be of sufficient quality to identify the work upon which to build the evidence, it is essential that user’s personal data is complete, accurate and up to date.

If we do not put the full name or last name, only use initials, there are typos or information is out of date, future certificates, taking the default information available at the time of registration, will also be generated incomplete and perhaps even wrong. This may involve a number of problems especially if you want to use the evidence authorship independently from Safe Creative.

So the more and better information you fill in, the better it will be to make the most out of the evidence generated in Safe Creative. So remember to fill out with the best and accurate information. Those who already have done it, periodically verify that the email, your address and any other information is perfectly updated and without errors.

You can set registrations to have a 24 hours perido after uploading whre it remains in pre-registration, a period during which it is possible to edit it to perform any change, including the same file.

If you want to include in the registered work the registration label:
1 .- Make the standard registration of the work.
2 .- Once registered, in the listing of works (“My registrations”), select the “Manage registration” button and select the “Informative labels” icon.
3 .- Choose the label you feel is most appropriate.
4 .- Paste the label on the part of the work that you think is more appropriate.
5 .- Before the end of the 24 hours pre-registration period, edit the entry and replace the uploaded file with the the one that now does have the label in it.

Metadata is information included in a digital file providing key information about the content the file “holds” and the format itself.
These data can be accessed with specific programs and allow you to learn and manage relevant information about the file and / or work.

From the tab “My registrations” you can manage batch actions for several works at once, selecting and applying the desired action contained in the upper part, “Manage selected registrations”, to the works you have selected.

To change the preview image of a work we have only to select to change of it from the  window that opens when hitting “Manage my work” button. You will see a “Change preview image” icon there. The system will ask you to upload a new image from our computer or you might use the generic image of the paint palette instead.
